Please review these terms and conditions governing your use of our Australian business directory, classifieds, and community marketplace services.

- ✓ Zero tolerance for fraudulent reviews, illegal listings, or copyright infringement.
- ✓ Transparent cancellation and cooling-off refund policies for premium subscriptions.
1. Acceptance of Terms & Australian Jurisdiction
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and OmniCity Australia ("we", "us", or "our"). By accessing or using our website, mobile interfaces, or any associated APIs, you agree to be bound by these Terms and our Privacy Policy.
These Terms are governed by and construed in accordance with the laws of New South Wales and the Commonwealth of Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
2. Australian Consumer Law (ACL) Guarantees
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be lawfully excluded.
If our services fail to meet a statutory consumer guarantee under the ACL, you may be entitled to a remedy, including resupply of the service or a refund for major failures.
3. User Accounts & Identity Verification
To access certain features (such as listing a business, booking an appointment, posting an RFQ, or selling on classifieds), you must register an account. You represent and warrant that:
- All information provided during registration is accurate, current, and complete.
- If registering on behalf of an Australian business entity, you hold the authority to bind that entity and provide its valid ABN/ACN.
- You are at least 18 years of age or possess legal parental/guardian consent.
- You will maintain the security and confidentiality of your login credentials.
4. Business Listing & Merchant Guidelines
Business owners and authorized representatives listing their services on our directory agree to:
- Provide truthful trading names, registered Australian addresses, active contact numbers, and valid operating hours.
- Hold all necessary state trade licenses, professional accreditations (e.g. AHPRA for medical providers), and public liability insurance required by Australian law.
- Promptly honor promotional deal vouchers and gift cards sold through the platform in accordance with the Treasury Laws Amendment (Gift Cards) Act 2018 (minimum 3-year expiry).
5. Reviews, Ratings & Content Policy
We pride ourselves on transparent, unmanipulated consumer feedback. Users agree not to submit false, misleading, defamatory, or commercially coerced reviews. Business owners may not review their own listings or offer financial incentives in exchange for positive reviews.
We reserve the right to remove any content that breaches our Community Guidelines or contravenes Section 18 of the Australian Consumer Law regarding misleading and deceptive conduct.
6. Fees, Payments & Subscription Cancellations
All prices quoted on the website are in Australian Dollars (AUD) and inclusive of 10% Goods and Services Tax (GST) unless explicitly stated otherwise. Recurring subscription plans may be cancelled at any time via your Account Dashboard with no lock-in cancellation fees.
7. Limitation of Liability
To the maximum extent permitted by Australian law, OmniCity Australia is not liable for indirect, incidental, special, or consequential damages resulting from transactions conducted between independent users, buyers, and third-party service providers listed on the directory.
8. Dispute Resolution & Contact Information
In the event of a dispute, we encourage users to first contact our Australian Support Desk at support@omnicity.com.au. We will make all reasonable efforts to resolve your complaint within 14 business days.
This legal agreement is governed under the laws of New South Wales and the Commonwealth of Australia. All rights reserved.
